TOBACCO DIRECTORY BY BRAND
This Directory identifies cigarette and “roll-your-own” tobacco brands
and tobacco manufacturers that are in compliance with Title 16, Subtitle 5 of
the Business Regulation Article of the Maryland Code. Section 16-504(c) of the
Business Regulation Article prohibits selling, offering or possessing for sale
in Maryland, or importing for personal consumption in Maryland, cigarettes of
a tobacco manufacturer or brand family not included in this Directory.
The Directory includes an alphabetical listing of all cigarette manufacturers.
The Directory lists manufacturers that are participants in the Master Settlement
Agreement (denoted as “PMs”) and non-participants in the Master
Settlement Agreement (denoted as “NPMs”), along with their respective
brand families that have been certified for sale. You also may view the directory

The Directory further identifies the brand styles that have been certified
by the Comptroller of Maryland as meeting fire safety standards pursuant to § 16-601
et seq. of the Business Regulation Article. To learn which brand styles have
been approved as fire standards compliant, click on the “+” next
to the brand family. Wholesalers may apply tax stamps only to those brand styles
listed on the Directory as subcategory of a brand family. If there is no “+” next
to a brand family, no brand styles in that brand family have been approved
as firesafe, and wholesalers are prohibited from applying tax stamps to that
brand family. Retailers are prohibited from selling brand styles that have
not been approved as fire standards compliant unless those brands were lawfully
tax stamped prior to July 1, 2008.
Effective September 22, 2009, pursuant to Section 907(a)(1)(A) of the Federal
Food, Drug, and Cosmetic Act, as amended by Section 101 of the Family Smoking
Prevention and Tobacco Control Act, a cigarette or any of its component parts
(including the tobacco, filter or paper) shall not contain, as a constituent
(including a smoke constituent) or additive, an artificial or natural flavor
(other than tobacco or menthol) or an herb or spice, including strawberry,
grape, orange, clove, cinnamon, pineapple, vanilla, coconut, licorice, cocoa,
chocolate, cherry or coffee, that is a characterizing flavor of the tobacco
product or tobacco smoke. According to the FDA, cigarettes and their component
parts that fail to comply with the special rule established under Section 907
are deemed adulterated under Section 902 and as such are subject to seizure
under Section 304 as well as other enforcement action under the Federal Food,
Drug, and Cosmetic Act. Roll-your-own tobacco products are listed on the Directory
by brand family, not by brand style. Some styles of RYO brand families which
are listed on the Directory may contain certain characterizing flavors and
as such may be deemed adulterated as provided above.
Effective July 22nd, 2010, pursuant to Section 911 of the Federal Food, Drug,
and Cosmetic Act, as amended by Section 101 of the FSPTCA, cigarette manufacturers
may no longer introduce into domestic commerce cigarettes which suggest a lower
risk of the harm from using the tobacco product as compared to other commercially
available tobacco products, unless it has been specifically approved by the
Secretary of Health and Human Services. This includes products that contain
descriptors such as “light”, “low”, “mild” or
other similar terms. However, cigarettes that were introduced into domestic
commerce prior to July 22nd, 2010 may remain on retail shelves after that date.
The Maryland Tobacco Directory lists those brand styles that have been certified
by the Office of the Comptroller as meeting fire safety standards pursuant
to § 16-601 et seq. of the Business Regulation Article. New brand style
descriptors introduced to comply with the FSPTCA are provided in parentheses
after the previously approved brand style.
