FORMER COMPANY PAYROLL SUPERVISOR
SENTENCED FOR THEFT
Maryland Attorney
General Douglas F. Gansler today announced that Kimberly Ann
Henson Whitacre,
age 35, of 7729 West Shore Road, Pasadena, was sentenced by
Anne Arundel County Circuit Court Judge Joseph P. Manck to serve four months
of house arrest for the theft of over $51,000 from Allegis Group, Inc., the
staffing company where Whitacre worked from 1994 until September
2003. The Court also
imposed an additional 32-month suspended sentence and ordered Mrs. Whitacre
to complete three years of supervised probation. While on probation,
Whitacre must
undergo psychological and substance abuse evaluations, followed by counseling
as directed by the State Division of Parole & Probation. The defendant
previously paid restitution to Allegis Group in the amount of $51,173.73 following
her December
8, 2006 guilty plea.
The State’s investigation revealed that from January 7,
1998 until September 11, 2003, Whitacre was a supervisor in the
payroll tax department of the company. In her trusted position,
she had access to employee salary and payroll deduction information
stored in the company’s electronic payroll system. For over
five years, Whitacre unlawfully used her system access to manipulate
her personal tax data stored in the system, causing the company
to pay her personal tax withholding liability, rather than deducting
it from her paycheck as required by law.
Allegis Group discovered
the theft and actively participated in the criminal investigation
conducted by the Criminal Investigation
Division of the Attorney General’s Office. In making today’s
announcement, Attorney General Gansler thanked Assistant Attorney
General Kate O’Donnell for her work on this case.
