FORMER
DIRECTOR OF NONPROFIT CHARGED WITH THEFT
Attorney
General J. Joseph Curran, Jr. announced today the indictment
of Linda P. Lively, of 23681 Newtown Rd., Worton, Maryland, by
the
Cecil County, Maryland Grand Jury.
Lively,
53, was indicted September 20, 2004 on one count of felony theft
and one count of fraudulent misappropriation by a fiduciary in
connection
with her former employment with On Our Own of Cecil County,
Inc.,
a nonprofit organization that benefits the mentally disabled.
It is alleged that between January 2002 and June 2002, Lively
stole
more than $500 from the organization. An initial appearance
has been scheduled for October 13, 2004 in the Circuit Court
for
Cecil County.
All
individuals are presumed innocent until proven guilty beyond
a reasonable doubt. If convicted, the maximum penalty for felony
theft is 15 years and up to a $1,000.00 fine, plus restitution.
Fraudulent misappropriation by a fiduciary, if proved, carries
a maximum penalty of 5 years. The case will be prosecuted by the Office of the Attorney General,
Criminal Investigations Division.
