Health Care Decisions Act: Text and Educational Materials

Available here are several items for learning more about Maryland's Health Care Decisions Act and related law:

1. The text of the Act (as amended through 2014 legislation).

2. A summary of the Act.

3. A description of "health care proxies" - those who make decisions on behalf of patients who cannot do so personally.

4. Two PowerPoint slide shows. One presents on the Act's framework for health care decisionmaking. This presentation is designed primarily for clinicians.

The other, on advance care planning and advance directives, is intended for general audiences.

If you would like a representitive from the Attorney General's Office to do a presentation at your facility or group, please call (410) 576-6327.

5. Charts that set out a decision tree for use by physicians and other clinicians.

6. Documenting Surrogate Self-Selection

Sometimes surrogates with equal authority (e.g., adult children) decide among themselves who they want to act as the sole surrogate. In terms of the Health Care Decisions Act, the others make themselves “unavailable” by agreement. This is explained in the letter at this link: http://www.oag.state.md.us/healthpol/knutson.pdf.

An example of a surrogate decision making agreement may be accessed here.
